Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of HappeningIn, including the website, event guide, event-detail pages, saved-event features, source links, and any related services we provide (collectively, the “Service”). The Service is operated by Apollo Digital Foundry (“Apollo,” “we,” “us,” or “our”). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What HappeningIn does
HappeningIn provides a curated, chronological guide to events and things to do in a city. Event listings may be collected from public websites, ticketing platforms, venue calendars, event organizers, partners, automated data providers, and other sources. We try to make the Service useful and accurate, but the Service is informational only and is not the organizer, host, venue, promoter, ticket seller, emergency service, or transportation provider for events listed on the Service unless we expressly say otherwise.
2. Event information is not guaranteed
Event names, dates, times, venues, prices, availability, age restrictions, cancellation status, accessibility information, policies, images, and source links can change without notice. We do not guarantee that any event information is complete, current, error-free, available, suitable for you, or safe. Before attending, purchasing tickets, making travel plans, or relying on any listing, you are responsible for verifying the details directly with the official organizer, venue, ticketing page, or other authoritative source.
3. Third-party sites, tickets, and purchases
The Service may link to third-party websites or services. We do not control and are not responsible for third-party content, terms, privacy practices, ticket availability, refunds, fees, safety policies, or transactions. If you buy a ticket, RSVP, subscribe, download an app, or otherwise interact with a third party, that relationship is between you and the third party. We are not responsible for losses or disputes arising from third-party websites, events, purchases, or services.
4. Eligibility and acceptable use
You may use the Service only if you can legally enter into these Terms and only in compliance with applicable law. You agree not to misuse the Service, including by attempting to disrupt it, reverse engineer it, bypass security or access controls, scrape it in a way that burdens our systems, submit malicious code, impersonate others, infringe intellectual-property or privacy rights, or use the Service to facilitate unlawful, harmful, deceptive, threatening, harassing, or abusive activity.
5. Accounts, saved events, and local device data
The current Service does not require an account to browse events. Some convenience features, such as saved events, may store data locally in your browser or device. If account-based features are added later, you will be responsible for keeping your credentials secure and for activity under your account. We may suspend or terminate access to any feature if we believe these Terms or applicable law have been violated.
6. User submissions and feedback
The current Service may not accept public event submissions. If we later allow you to submit events, feedback, text, images, links, corrections, or other materials, you represent that you have the rights needed to provide them and that they are lawful, accurate to the best of your knowledge, and not confidential. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, publish, display, distribute, and use those materials to operate, improve, market, and protect the Service. We may remove or decline any submission at any time.
7. Intellectual property
The Service, including its design, software, branding, text we create, compilations, and overall presentation, is owned by Apollo or its licensors and is protected by intellectual-property laws. Event names, venue names, organizer names, logos, images, and other third-party materials remain the property of their respective owners. These Terms do not grant you any ownership rights in the Service or third-party materials.
8. Copyright concerns
If you believe content on the Service infringes your copyright or other rights, contact us with enough detail for us to identify the material, evaluate the concern, and respond appropriately. Include your name, contact information, the URL or description of the content, a description of the rights at issue, and a statement that your notice is accurate.
9. Changes, availability, and experiments
We may update, suspend, limit, remove, or discontinue any part of the Service at any time, including event sources, categories, cities, layouts, links, features, and policies. We may run experiments or previews and may change the Service without notice. We do not guarantee uninterrupted access, data retention, or compatibility with every device, browser, network, or platform.
10. Disclaimers
To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, or reliability. You use the Service and attend or interact with events at your own risk.
11. Limitation of liability
To the fullest extent permitted by law, Apollo and its owners, employees, contractors, agents, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for loss of data, goodwill, opportunities, revenues, or business, arising out of or related to the Service or these Terms, even if we have been advised of the possibility of such damages. To the fullest extent permitted by law, our total liability for all claims relating to the Service or these Terms will not exceed the greater of $100 or the amount you paid us, if any, to use the Service in the 12 months before the claim arose.
12. Indemnity
You agree to defend, indemnify, and hold harmless Apollo and its owners, employees, contractors, agents, affiliates, and service providers from and against claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Service, your violation of these Terms, your violation of law, your submissions or feedback, or your infringement or misappropriation of any rights.
13. Governing law and venue
These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. To the extent a dispute is not subject to arbitration or small-claims court, you and Apollo consent to the exclusive jurisdiction and venue of the state and federal courts located in King County, Washington.
14. Updates to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Service after updated Terms are posted means you accept the updated Terms.
